Access to Council Information
The GIPA Act is complemented by the Privacy and Personal Information Protection Act 1998 (PPIPA), which establishes a right to amend personal information in records held by Councils and other government agencies - new Part 6A. For more information on PIPPA legislation, please refer to Privacy under GIPA.
For more information about the new legislation please visit the Office of the Information Commissioner's website.
Under the Government Information Public Access Act (GIPA) 2009 there is a presumption in favour of the disclosure of Council information unless there is an overriding public interest against disclosure. The GIPA Act establishes four ways to access information:
Please note that we can no longer guarantee confidentiality if you make a submission or comment to Council, including submissions on Development Applications. In the case of DAs, the GIPA Act requires that we publish your comments on our website.
MAKING AN APPLICATION TO ACCESS COUNCIL'S DOCUMENTS AND INFORMATION
Council has a designated Public Officer, as set out under section 342 of the Local Government Act. In some instances the Public Officer may be referred to as the Right to Information Officer.
Part of the Public Officer's role is to deal with applications requesting Council's information. Our Public Officer is John Whitfield, Director Corporate & Community Services.
Applications are required for access to Councils documents and information unless it is available on Council's Website. Applications forms are available for download from the Access to Council Information section of Council's Public Documents. They can be lodged at Council's Offices, emailed to firstname.lastname@example.org or faxed to 6924 2497.
We advise you to check under the Open Access information section of this website before submitting an application form. Important information is also available in the Frequently asked questions and Privacy under GIPA sections.
For more information about access to Council's information, or the type of application you need, please contact John Whitfield on 6924 8100.
The Information and Privacy Commission New South Wales website at www.ipc.nsw.gov.au is also very informative about accessing Council's information.
